This website or mobile application platform (“Platform”) is offered, owned and controlled by FUNDS4YOU ECOMM - FZCO (also referred to as the “Company”, “We”, “Us” or “Our”). We value your (“you” or “your” or “User”) privacy and are committed to protecting your personal data in compliance with the Federal Decree-Law No. 45 of 2021 on Personal Data Protection (“PDPL”) and all applicable laws. This policy (“Privacy Policy” or “Policy”) explains how we collect, process, and safeguard personal data, and outlines your rights under the PDPL.

This Policy applies to:

  • Visitors (current, previous and future) to our Platform; and
  • Users who create and account with us or register to use our services.

By using and/or accessing our Platform and services, you consent to this Policy and our data processing practices. If you do not agree with this Policy, you must stop using our services and accessing our Platform.

2.Definitions

Unless the context otherwise requires, the following terms used in this Privacy Policy shall have the meanings assigned to them below:

  • Biometric Data: Personal Data resulting from Processing using a specific technology related to the physical, physiological or behavioral characteristics of the Data Subject, which allows the identification or confirmation of the unique identification of the Data Subject, such as facial images or fingerprints.
  • Controller: The establishment or natural person that has Personal Data, and by virtue of its activity, determines whether individually or jointly with other persons or establishments, the method and criteria for Processing such Personal Data and the purpose of Processing it.

  • Sensitive Personal Data: means any data which directly or indirectly reveals a natural person's family, ethnic origin, political or philosophical opinions, religious beliefs, criminal record, biometric data, or any data relating to person's health and physical, psychological, mental, genetic or sexual condition, including information related to the provision of healthcare services to their which reveals their health status.
  • Third-Party Authentication Services: means any third-party identity verification or authentication services that allow you to access or create an account on the Platform through an external account or platform, including services such as Google Sign-In, Apple Sign-In, Facebook Login or similar authentication providers.

3.Personal Data we collect about you

We collect the following Personal Data about you:

  • Identification data: Name, email address, home address, date of birth, identification documents (such as passport copy) and contact number.
  • Financial data: Payment details, such as bank account, payment card information, blockchain wallet addresses, transaction data (e.g., amounts, time, date, and nature of the transactions).
  • Device and usage data: Information about your device (such as IP address, browser type, device type, and operating system) and how you use our services (e.g., login history, page views).

We may collect the Personal Data during the signup process on our Platform, directly or by way of Third-Party Authentication Services, or in course of your use of, our services.

You undertake that all Personal Data provided to us by you, directly or indirectly by way of Third-Party Authentication Services, is true, complete, and accurate and you must notify us of any changes to such Personal Data within a reasonable timeframe after such change has been affected.

Information you provide to us directly: We collect Personal Data that you provide to us directly through your interaction with our Platform and services, including when you register for an account or communicate with us. This may include:

We do not knowingly collect data from, or market to, individuals under 18 years of age. By using the services, you represent that you are at least 18 years. If we learn that Personal Data from users who are less than 18 years of age has been collected, we will deactivate your access to our services and take reasonable measures to promptly delete such data from our records.

6.Purpose

This Policy has been developed for compliance with the PDPL and other applicable laws. It governs how we collect, use, disclose, store, transfer and protect your Personal Data in connection with all legal and regulatory compliance requirements, in relation to any marketing or general communications, or any other matters in connection with your access to and use of the Platform and the services made available through the Platform.

Without certain Personal Data, we may not be able to provide you with access to the Platform, facilitate your use of the Platform and its features, the services or otherwise support your requests. This Privacy Policy explains:

  • The types of Personal Data we disclose to third parties and the categories of those third parties; and

7.Personal data protection principles

Your Personal Data is collected and processed in accordance with relevant data protection principles, including lawfulness, fairness, and transparency; purpose limitation; collection limitation; data minimization; accuracy; rectification measures; storage limitation; integrity and confidentiality (security); with all relevant laws and regulations considered; and however applicable.

8.Legal Basis for Processing Personal Data

We process your Personal Data only for a lawful purpose under the following legal bases in line with PDPL:

  • Consent: By agreeing to this Policy, you consent to the processing of your Personal Data as described.
  • Performance of a contract: Data processing is necessary to provide services under our agreements with you.

For certain cases, each a lawful purpose, the Company may also Process Personal Data without your express consent, as permitted under applicable law. The scenarios in which the Company can Process Personal Data without the express consent of the concerned Data Subject include:

  • Processing is related to Personal Data made publicly available by the Data Subject;
  • Processing is necessary to initiate or defend procedures relating to claim of rights and legal actions or are associated with legal or judicial procedures;
  • Processing is necessary for the performance of any contract entered into where the Data Subject is a party or for taking any action upon Data Subject’s request for concluding, amending, or terminating such contract; and
  • Processing is necessary for public interest.

For the purpose of this Clause 8, a "lawful purpose" is any purpose which is not expressly prohibited by the law. The purpose shall be deemed to be no longer served if the Data Subject does not approach the Company for the performance of the specified purpose and exercises any of their rights in relation to such Processing, for the period defined under applicable laws.

9.Processing and Use of Aggregated, Anonymized, and De-Identified Data

We may generate, handle, compile, and share data that has been aggregated, anonymized, or de-identified, in compliance with applicable laws. To anonymize data, we remove any elements that could directly or indirectly reveal your identity, such as your name, contact information, or other personal identifiers. In addition, we employ pseudonymization by substituting identifiable data with randomly generated codes or placeholders, ensuring that such data cannot be traced back to you without access to separate, securely stored information. We take extensive technical and organizational measures to secure these processes and prevent any re-identification of individuals.

10.Consent

By accessing and/or using this Platform, you provide consent to the processing of your Personal Data (whether provided directly by you, collected by us, or received from third parties) for the purpose of fulfilling any and all legal obligations arising from any contracts entered into with you, or to deliver the services you have requested from us. This includes taking necessary steps at your request prior to entering into a contract.

By signing up for or applying for services through our Platform, you authorize and consent to our obtaining and disclosing your Personal Data to third parties for purposes such as payments processing, identity verification, account verification, fraud detection, or collection procedures, or as otherwise permitted or required by applicable law.

By accessing and/or using this Platform, you acknowledge and expressly consent to the transfer, storage and Processing of your Personal Data outside the United Arab Emirates where this is necessary for access and use of the Platform, the performance of our services, the operation of our business, or any of the purposes described in this Privacy Policy. Such transfers may include transfers to our affiliates, service providers, cloud hosting providers, analytics providers, Third-Party Authentication Services, third-party proprietary trading firms, payment processors and other third parties located in jurisdictions that may not provide the same level of data protection as the United Arab Emirates. Where required by applicable law, we will implement appropriate safeguards and take reasonable measures to ensure that your Personal Data continues to be protected in accordance with this Privacy Policy and the PDPL.

You may withdraw your consent at any time. The withdrawal of consent will not affect the lawfulness of processing based on consent provided prior to its withdrawal. 11.Use of Personal Data

The Company keeps all necessary records on Personal Data for the period provided under the applicable laws. Unless the retention of Personal Data is necessary for any statutory/regulatory compliance purposes, the Company shall erase Personal Data.

The Company protects Personal Data, payment data or transaction data by implementing technical and operational measures for storing and maintaining the Personal Data, for preventing the data breaches, and for maintaining confidentiality, integrity, and availability of Personal Data.

The Company holds, stores and maintains all Data or records required under the applicable laws in UAE, and maintain safe and secure backup of all such data and records in a separate and secure location for the applicable retention period prescribed under the applicable law and any requirements of the Central Bank of the United Arab Emirates.

The Company shall ensure that the rights of the Data Subject are enabled as per applicable laws.

The Company may also undertake a data audit at periodic intervals to evaluate the compliance with the provisions of applicable laws.

Third-party service providers: We may use third-party service providers to process your Personal Data within the UAE or other countries. Such processing will always be based on a legitimate legal ground and performed according to the lawful instructions provided by the Company, ensuring full compliance with the PDPL and other relevant laws.

12.Disclosure of your Information to third parties

Whenever we share your Personal Data with third parties, such as our service providers or affiliates, we ensure that these parties are contractually obligated to protect your Personal Data in accordance with the strictest standards of data protection. This Policy does not apply to, and we are not responsible for the privacy policies of these third-party websites regardless of whether they were accessed while using links from our Platform or communications.

17.Your rights in relation to your Information

Right of access to information: You are entitled to request and receive details regarding:

  • Any automated decision-making that involves your Personal Data;

Right to rectification: If you find that any Personal Data we hold about you is inaccurate or incomplete, you have the right to request that we rectify or update the information accordingly.

Right to erasure: You may request the deletion of your Personal Data under the following circumstances:

  • The Personal Data is no longer necessary for the purposes for which it was collected;
  • You withdraw consent, and there is no other legal basis for processing;
  • You object to the processing of your Personal Data, and there are no overriding legitimate grounds;
  • The data has been unlawfully processed; or
  • The erasure is necessary to comply with applicable laws or regulations.

However, your request for erasure may be refused if the Personal Data is required for legal obligations or the establishment, exercise, or defence of legal claims.

  • The processing is carried out using automated means.

Where technically feasible, you may also request that we transmit your Personal Data directly to another entity at your direction.

Right to object to automated decision-making: You may object to decisions made purely through automated processes if such decisions have legal or significant consequences for you. However, we may deny such requests if the automated decision-making is necessary for fulfilling contractual obligations, required by law, or if you have explicitly consented to it.

Right to lodge a complaint: If you believe that your Personal Data rights have been violated, you have the right to file a complaint with the UAE Data Office.

18.Submission of requests for exercise of rights

We aim to respond to all legitimate requests without undue delay and within 2 calendar months of receipt of any request from you. Occasionally it may take us longer than 2 calendar months, if your request is particularly complex, or if you have made duplicated or numerous requests. In this case, we will notify you of receipt of such request(s) and keep you updated as to the status of progress concerning such request(s).

We may need to request specific information from you to help us confirm your identity and ensure your entitlement to such rights. 19.Data retention

We retain on your behalf, any Personal Data, transactional data, or other session data, linked to your account.

Your Personal Data will be processed for no period longer than as required by us for the purposes it was collected for, for the purposes of using our services, and for meeting any legal, accounting, reporting, government, regulatory or law enforcement requirements.

20.Security precautions and measures

We are committed to ensuring that your Personal Data is secure. To prevent unauthorized access or disclosure we have put in place suitable physical, electronic, and managerial procedures to safeguard and secure the Personal Data we collect via our Platform. We use industry-standard technical mechanisms and ensure that our affiliates or vendor entities use data encryption technology while implementing restrictions related to the storage of and the ability to access your Personal Data.

Our facilities are scanned on a regular basis for security holes and known vulnerabilities, to best ensure its security.
